  3. 3. Why Grundnorm? A Treatise on the Implications of Kelsen's Doctrine

    University dissertation from Stockholm : Institutet för rättshistorisk forskning (The Ohlin Foundation for Legal History)

    Author : Uta Bindreiter; Lunds universitet.; Lund University.; [2000]

    Abstract : The treatise is concerned with the source-—the “Grund”--of the bindingness of law. I contend, first, that the “presupposition” of the basic norm, on a certain reading of Kelsen’s doctrine, can be understood as constituting a normative source of positive law, and, secondly, that this reading of Kelsen admits of addressing the issue of the (formal) legitimacy of supra-national and “directly applicable” rules and other norms. 5. 5. A Concept in Search of a Principle : An Analysis of the Origins and Development of the Contested Notion of Self-Determination in International Law

    University dissertation from Det juridiske fakultet

    Author : Miriam Mckenna; [2015]
    Keywords : SAMHÄLLSVETENSKAP; SOCIAL SCIENCES; Self-determination; Decolonisation; Legal sociology; Bourdieu; Critical legal theory;

    Abstract : Employing a socio-legal approach that draws on Bourdieuian studies of law, this study critically examines self-determination’s status as a norm of international activity by tracing the manner in which it has been articulated and transformed by a number of key actors, the empirical and theoretical tensions accompanying its trajectory, and the negotiations and interactive contestations that lie outside of a functionalist historical approach. This study contends that the law of self-determination is not and has never been a settled matter in either legal or political doctrine, rather that it has been continuously developing conceptually and pragmatically in response to changing geopolitical pressures and legal and political climates.
